PBR: Essentially derived varieties

Overview

IP Australia is seeking views on whether provisions for essentially derived varieties (EDVs) of plants are operating effectively under Australia’s plant breeder’s rights legislation. IP Australia would like to understand any potential issues more clearly, including any evidence that may demonstrate a need for legislative change.

IP Australia has published a discussion paper that outlines the EDV concept, the current legislative framework and potential areas for reform.
